Kelly Guzzo Sues LexisNexis for Errors in Auto Insurance Reports

Many consumers are unaware that their auto insurance rates can be affected by reports maintained by LexisNexis, known as C.L.U.E. reports. These reports are used by insurers to assess risk and determine premiums. Unfortunately, errors in these reports can have serious financial consequences.

Recently, Kelly Guzzo filed a lawsuit against LexisNexis on behalf of a woman whose auto insurance rates increased because of inaccurate information in her C.L.U.E. report. The consumer believed her identity was being misused, but the real issue was that LexisNexis had confused her with another individual who shared a similar name and date of birth. We allege that LexisNexis’ inadequate matching procedures allowed this error to occur, resulting in higher insurance costs for our client.

The lawsuit asserts violations of the Fair Credit Reporting Act (FCRA). While the FCRA is often associated with traditional credit bureaus, it also applies to specialty reports such as those provided by LexisNexis for insurance purposes.
