Kelly Guzzo, PLC recently filed multiple lawsuits in federal court alleging that a company wrongfully shared consumers’ criminal record information with potential landlords. One lawsuit alleges that expunged criminal records were improperly provided to landlords. Another alleges that the criminal record of the wrong consumer was included in a tenant’s background report.
The company, a subsidiary of TransUnion known as “SmartMove,” conducts background checks on potential renters and shares that information with landlords. The lead plaintiffs in these cases had a home rental application rejected because of SmartMove’s inaccurate criminal record information.
In both cases, Kelly Guzzo is suing for damages under the Fair Credit Reporting Act, which requires that companies employ reasonable procedures to ensure that background checks have both accurate and up-to-date criminal record information.
