Identity Theft Led to Fraudulent Loan on Credit Report
This case arises from a Washington, D.C. consumer who was the victim of identity theft in late 2023, which resulted in a fraudulent loan account being opened in her name.
Despite clear signs of fraud, the financial institution treated the account as valid and pursued repayment. In an effort to protect her credit, the consumer initially made payments while simultaneously disputing the account with the credit bureaus.
Over the course of more than a year, she submitted multiple disputes to Experian, Equifax, and TransUnion, providing documentation showing the account was fraudulent. Despite this, the account allegedly remained on her credit reports.
Alleged Failures by the Credit Bureaus
Under the Fair Credit Reporting Act, credit reporting agencies are required to ensure maximum possible accuracy and conduct reasonable investigations when consumers dispute inaccurate information.
The lawsuit alleges that the credit bureaus failed to meet these obligations by relying on the financial institution that furnished the information rather than conducting an independent review.
As a result, the inaccurate account continued to appear on the consumer’s credit reports, creating financial strain and placing her in a difficult position.
