Kelly Guzzo Files Case Against Credit Reporting Agencies for Mixing Consumer’s Credit File with Relative’s

Kelly Guzzo, PLC recently filed a lawsuit in federal court in Maryland on behalf of a consumer whose credit reports showed debts belonging to his father, who shared a similar name. Because our client did not incur those debts, his credit reports should not have shown that he owed them.

This “mixed file” happens when a consumer’s credit report shows accounts or other information belonging to someone else. Most often, mixed files happen when a family member – or even a complete stranger – shares a similar name.

Making matters worse, the credit reporting agencies repeatedly refused to remove the negative and inaccurate information despite several notices from our client. In the lawsuit, Kelly Guzzo alleged that the credit reporting agencies each willfully violated their duties under the Fair Credit Reporting Act (FCRA).
